There's one thing you can try in order to check if this is hardware or software. For what it's worth my bet is on hardware...
You'll need the yellow [SHIFT] key to work once for this:
Press [SHIFT] and then [SETUP] (on the '0' (zero) key).
From there, go into the "System" menu (press '4' and then '2').
Select "Diagnostics" (press '2')
The second line from the bottom should show something like this:
key= 0- 0 (counting digits)
Whenever you press the [SHIFT] key, the first '0' should become '28', so you should see something like:
key=28 - 0 (........)
It reverts to "key= 0 - 0" when you release the button. Keep on pressing [EXIT] to leave the diagnostics page and the System menu.
If that isn't happening then it could be a tiny amount of residual matter of some kind in the contact for the button. If this is the case then I think it will become normal with a bit of use.

Anybody can confirm me that in order to turn on the calculator isn't necessary to push the shift + ON (in yellow)? And tha a single push onto the EXIT key does the job? Is this behaviour right?

When the DM42 is on, pressing Shift-EXIT turns it off.

My DM42 also arrived today (just in time for the final exam of my accounting class tomorrow). What an impressive piece of kit!
I realized that the keys are quite hard to press, much harder in fact that the other calculators I have been using recently. As a result some key presses did not register when I was typing fast. Maybe the same happened to you? I think the keyboard requires getting used to. There might be some break-in as well.

Yes, Sir. Look at the Voyagers and Pioneers - all of them were (and are) turned on this way. That's the reason why the EXIT/ON key is lower than all other keys to prevent inadvertent activation of the calculator. Setting up the date and time, I have realised my device has some keyboard issues too. The worse is that the third function key misses a good deal of the keystrokes and then it seems to speed up and with a single keystroke produce the same effect as several of them. I hope to find a solution in the beta testers forum fir this kind of problem.
Less serious is that the up arrow key need a hard press to be recognised, a casual keystroke although with the hactic feedback is not enough.
Edit: I have noticed that all of it boils down to some keys needing a stronger pressure to work properly. In the date/time setting menu it translated in the same effect as a continuous pressing of the key with numbers moving fast.
